The agreement
These terms govern access to OctaMem’s persistent memory infrastructure. By using the service you agree to be bound by them. If you’re entering into this on behalf of an organization, you represent that you have authority to do so.
Acceptable use
Don’t use OctaMem to break laws, evade copyright, attack infrastructure, or store content you don’t have the right to store. We can suspend accounts that do, though we always try to contact you first.
Customer data
Memory records and source documents you send us are yours. We hold them under the privacy and data-protection commitments at /legal/privacy and the DPA at /legal/dpa.
Service availability
We target 99.99% availability for Business and Enterprise plans, with SLA credits as defined in the order form. Status and incident history are public at status.octamem.com.
Termination
You can terminate at any time. We can terminate for material breach, non-payment, or unlawful use. On termination, memory and source documents are deleted within 30 days unless a longer retention period is required by law or by your plan.
Liability and warranties
Service is provided as is. Our aggregate liability is capped at the fees paid in the 12 months preceding a claim. Full warranty and limitation language is in the master service agreement on Enterprise plans.
